أحكام المفقود في الفقه الإسلامي وقانون الأحوال الشخصية الإماراتي

الملخص
ملخص البحث: يهدف هذا البحث الموسوم:" أحكام المفقود في الفقه الإسلامي وقانون الأحوال الشخصية الإماراتي"، إلى بيان أحكام المفقود في كل من الفقه الإسلامي وقانون الأحوال الشخصية الإماراتي، وقد تأتّى له ذلك في مطلب تمهيدي وهو مدخل مفاهيمي لوضع المفاهيم في نصابها، وثلاثة مباحث رئيسة: الأول: في بيان أحكام مال المفقود، والثاني في بيان أحكام زوجة المفقود، والثالث في بيان أحكام إرث المفقود. وكان من نتائج البحث: أنّ كلا من الفقه الإسلامي والمشرع الإماراتي حرصا على الحفاظ على حقوق المفقود، ووضعا من الضوابط ما يضمن عدم الاعتداء عليها، ولقد أبدعا في تكييف طبيعة الفقد، حينما جعلا المفقود حيا في حق نفسه، ميّتا في حق غيره، فوازنا بين حقوق المفقود وحقوق غيره، كما احتاطا للحكم بوفاته ووضعا من القيود ما يجعل القاضي لا يلجأ إليها إلاّ عندما تتوافر دواعيه. The rules of the missing in Islamic jurisprudence and the personal status law of UAE Abstract: This research aims to : “The rules of the missing in Islamic jurisprudence and the UAE personal status law”, to clarify the rules of the missing in both Islamic jurisprudence and the UAE personal status law, and its defined in an introductory of the study, as well as there are three main topics: the first topic explains the rulings of the lost person’s money, the second topic describe the rulings of the wife missing person, and the third topic clarify the rules of the missing. The results of the research were that both Islamic jurisprudence and the UAE legislator abide by the rights of the missing, and a set of regulation to ensure that they are not abused , and they excelled in adapting the nature of the loss, they informed the missing person alive in the right of himself, dead in the right of others, a balance between The rights of the missing and the rights of others, as well as the rules for his death and a set of restrictions, which causes the judge to resort to it only when his reasons are available.
