الغش التجاري في الفقه الإسلامي والقانون الإماراتي: حقيقته، وآثاره، وطرق مكافحته

الملخص
ملخص البحث تُعدّ ظاهرة الغش التجاري من أخطر الظواهر التي تهدد اقتصاديات الدول في العصر الحالي، خاصة أنه أصبح يأخذ أشكالا وصورا حديثة ومموهة غير تلك التقليدية التي كان يظهر بها في الماضي، مما جعل من الصعوبة كشفه من قِبل الجهات الرقابية، ومن ثمّ مكافحته. ولقد جاء هذا البحث ليسهم – في حدود الإمكان – في الكشف عن حقيقة هذه الظاهرة، وليبيّن حكمها ودليلها، وكذلك حكم العقود التي تلبّست بها، وليميط اللثام عن مظاهر الغش التجاري القديمة والحديثة، مع تحديد آثارها على المستهلك وكيفية حماية حقوقه. كما يحاول أن يسلّط الضوء على تأثير هذه الظاهرة السلبية على الاقتصاد القومي، ويبحث في تحديد طرق مكافحتها المادية والمعنوية، وذلك من منظور الفقه الإسلامي، وما يقابله في القانون الإماراتي. Abstract The phenomenon of commercial fraud is one of the most dangerous phenomena that threaten the economies of countries in the current era, especially as it is taking modern and subliminal forms and images other than the traditional ways used in the past, which made it difficult to be detected by the regulatory authorities, and then combating it. This research has contributed, to the extent possible, to revealing the truth of this phenomenon, and between its rule and its evidence, as well as the rule of contracts that included commercial fraud , and unveils the old and new aspects of commercial fraud, while identifying its effects on the consumer and how to protect his rights. This research also tries to shed light on the impact of this negative phenomenon on the national economy, and how to combat it materially and morally, from the perspective of Islamic jurisprudence, and the equivalent in UAE law.
