الاشكالات التي تثيرها الوصية في العلاقات الدولية الخاصة

الملخص

تثير الوصية المشتملة على عنصر أجنبي الكثير من الإشكالات في ظل العلاقات الدولية الخاصة، أبرزها مشكلة تنازع التكييفات، فقد اختلفت التشريعات حول تكييفها، في حين أن المشرع الجزائري أدرجها ضمن فئة الأحوال الشخصية و أخضعها للقانون الشخصي، أضف إلى ذلك إشكال تنازع القوانين، و صعوبة إيجاد قاعدة الإسناد المناسبة لحل الموضوع محل النزاع. و في نفس السياق، أخضع المشرع الجزائري الشروط الموضوعية للوصية لقانون جنسية الموصي وقت وفاته، أما شروطها الشكلية باعتبارها تصرفا قانونيا لقانون الموصي وقت الإيصاء أو قانون البلد الذي تمت فيه. Résumé Le testament qui comporte un élément étranger pose de nombreux problèmes au regard des relations internationales privées, notamment le problème des conflits d'adaptations, la législation différait quant à leur adaptation, tandis que le législateur algérien les incluait dans la catégorie du statut personnel et soumis au droit personnel, outre le problème des conflits des lois, et la difficulté de trouver la base appropriée pour résoudre le problème en litige. Dans le même contexte, le législateur algérien a soumis les conditions de fond du testament à la loi sur la nationalité du testateur au moment de son décès, alors que ses exigences formelles en tant qu'acte de la loi du testateur au moment du testament ou de la loi du pays dans lequel il a été fait. Abstract The testament that includes a foreign element raises many problems in light of private international relations, most notably the problem of conflicts of adaptations, the legislation differed about their adaptation, while the Algerian legislator included them in the category of personal status and subjected to personal law, in addition to the problem of conflict of laws, and difficulty Finding the appropriate base for resolving the issue in dispute. In the same context, the Algerian legislator submitted the substantive conditions of the testament to the law on the nationality of the testator at the time of his death, while his formal requirements as an act of the law of the testator at the time of thetestament or of the law of the country in which it was made.
