حقوق الدفاع في الخصومة الجزائية

الملخص
ملخص: يعد مبدأ احترام حقوق الدفاع من أهم ضمانات المحاكمة العادلة في مجتمع ديموقراطي، لذا يجد أساسه في الدساتير وفي القوانين الاتفاقية لحقوق الإنسان، فضلا عن قوانين الإجراءات الجزائية الداخلية لكل دولة قانون. ويكون ذلك بتكريس حق المتهم بنفسه أو بواسطة محاميه من دفع التهمة الموجهة ضده في مواجهة سلطة الاتهام، وتسليحه بما يلزم من وسائل الدفاع لضمان تثبيت براءته، كالحق في الإعلام والمترجم والاطلاع على الملف ومناقشة الشهود... هي حقوق ذات طابع شمولي، تولد جنينيا في مرحلة الاشتباه، وتتعاظم في مرحلة التحقيق، وتكتمل في مرحلة المحاكمة. إن تزويد المتهم بأسلحة مساوية لأسلحة النيابة العامة، يدافع بها شخصيا من خلال الحضور الشخصي، وأيضا من خلال الاستعانة والتمثيل بمحامي، هو الذي يضمن توازن أطراف الخصومة، وبالتالي الوصول للحقيقة التي هي مهمة العدالة الجزائية. Abstract:it is The principle of respect for the rights of defense is one of the most important guarantees of a fair trial in a democratic society, that is why it is enshrined in constitutions and conventional laws relating to human, and it is enshrined in domestic procedural penal laws of etch state, as well this can be realized through asserting the right for the defendant by himself or via a lawyer, to challenge the allegations made by the prosecution authority against him, and arming him with the necessary means to ensure the confirmation of his innocence, such as the right for information, interpreter, the right to have access to the file and examine the witnesses against him... these are rights of global nature. Those rights are modest at the stage of suspicion, become more important at the stage of investigation and are completed at the trial stage. The principal of equality of arms provides the defendant with arms equal to those of the public prosecutor's office, in order for him to defend himself through personal attendance between aided by a legal representative, this is what ensures the balance between the dispiriting parties, and thus, getting to the truth, which is the cornerstone of criminal justice system.
