عقوبة السجن وما يترب عليها من ضرر على الفرد والمجتمع

الملخص
الملخص: عقوبة السجن من العقوبات الشائعة قديما وحديثا، ولعلها في هذا العصر نسخت كل العقوبات ودخلت في كل القوانين وطالت كل المجالات، فكان من شأنها أن تحد من نسبة الجرائم والمخالفات، وأن تقلل من عدد المسجونين، إذ من المفترض أن تكون العقوبة مناسبة للجرم، رادعة وزاجرة لمن تسول له نفسه أن يرتكبه، محققة للأمن والطمأنينة داخل المجتمع، وهذا مالم نلمسه في واقعنا اليوم إذ ارتفع عدد المسجونين وبلغت معدلات الجريمة والمخالفات معدلات ليست بالهينة، وأكثر من ذلك فرض علينا واقعا مرا يتجرعه أهالي السجين من تشرذم وتسيب ووقوع في براثين المخدرات والدعارة بسبب فقدان العائل لهم، واقعا يستنفد الخزينة العامة للدول دون جدوى، فجاءت هذه الأسطر لتبين هذه الأضرار المترتبة من عقوبة السجن، عساها أن تكون أرضية لدراسات جدية تفكر في عقوبات بديلة أو أنماط أخرى لتقييد الحرية للخروج من هذا الواقع وتقلل من هذه الأضرار. Abstract: Imprisonment is a common punishment, old and new, and perhaps in this era copied all the penalties and entered into all the laws and extended all areas, it would reduce the proportion of crimes and offenses, and reduce the number of prisoners, as from The penalty is supposed to be an appropriate offense, a deterrent and an offense to those who beg him to it is committed by it, bringing security and tranquility within society, and this is not felt in our reality today, the number of prisoners has risen and crime and infraction rates have reached rates it is not easy, and more than that imposed on us a bitter reality dared by the prisoners' families from fragmentation, stigmatization and falling into drug clutches and prostitution due to the loss of their host, reality exhausts the public treasury of the countries in vain, so these lines came to show these the damages of the prison sentence, may be the ground for serious studies contemplating in alternative sanctions or other patterns to restrict freedom out of this reality and underestimate of these damages.
