الملخص

ظهر الفكر العقابي وتطور عبر مدارس عدة وتباينت العقوبة في أصلها وتنفيذها بين المدرسة التقليدية والمدرسة الحديثة وتميزت مدرسة الدفاع الاجتماعي في دورها لدعم أنظمة العدالة بالتميز في مبادئها وأهدافها، وذلك بالتأسيس لحقوق الأفراد داخل المجتمع من خلال النظر والبحث العلمي في فلسفة العقاب والبحث في مدى مشروعية تطبيق عقوبات سالبة للحرية كالسجن والحبس والتشريع لها، والنظر في تاريخ السياسة العقابية ومدى شمولية القاعدة القانونية. Punitive thought appeared and developed through several schools, and punishment differed in its origin and implementation between the traditional school and the modern school. The School of Social Defense was distinguished in its role in supporting justice systems by excellence in its principles and objectives, through the consolidation of the rights of individuals in the society through consideration and scientific research in the philosophy of punishment and research in the legality of its application of freedom-depriving penalties such as imprisonment and legislation, and a review of the history of punitive policy and the legal base comprehensiveness.
