Le Renforcement Du Bloc De Constitutionnalité à Travers L’article 188 De La Constitution.

Résumé
La dernière révision constitutionnelle de 2016 a introduit dans son article 188 une disposition sur les libertés, suivie d’une la loi organique en 2018 pour son application. En réalité, ces droits aussi bien dans leur application que pour le contrôle qui s’exerçait sur eux, faisaient partie du champ de compétence du juge de droit commun ou du juge administratif selon la nature de l’activité. L’avènement de ces textes est une révolution dans la garantie de ces droits ainsi que les activités qui en découlent à travers le cadre constitutionnel et juridictionnel. Ce qui va élargir le champ de compétence du juge constitutionnel. D’où la question qui s’impose d’elle-même :, Le contrôle par voie d’exception consacré par le législateur algérien dans ses aspects constitutionnel et législatif constitue t’il une étendue, voir un renforcement du bloc de constitutionnalité en Algérie ?. Abstract: The constitutional revision of 2016,introduced in article 188 the disposition on freedom, followed by the application of an organic law in 2018.these rights both in their application and in the controls exercised,were part of the jurisdiction of the common law judge and the administrative judge,depending on the nature of the activity.the initiation of these texts is a revolution in the guarantee of rights and the activities arasing therefrom through theconstitutional and judicial framework.this will broaden the scope of constitutional judges authority.hence the question,does this alteration in the constitutional revision and imposed by the algerian legislator in its constitutional and legislative aspects as an exception,lead to strengthening the constitutional bloc in algeria ?
