تمثل رقابة دستورية القوانين خلال فترات الانتقال الديمقراطي مسالة معقدة بالنظر لما يتخلل هذه المرحلة من اضطرابات قد تصل الى حل الأجهزة القضائية المكلفة بالحفاظ على علوية الدستور. و قد شهدت تونس منذ سنة 2011 فراغا مؤسساتيا تمثل في غياب محكمة دستورية. سعت المحكمة الادارية في ظل هذا الفراغ الى تجاوز جدية الموانع المفروضة على القاضي العادي بخصوص رقابة دستورية القوانين و الإقرار بوجود مبادئ ذات قيمة دستورية خارج الدستور تمثل المرجع القانوني لحماية الحقوق و الحريات. ABSTRACT Monitoring the constitutionality of laws during periods of democratic transition is a problematic issue due to the turbulence that could lead to the dissolution of the judicial bodies responsible for preserving the supremacy of the Constitution. Since 2011, Tunisia has experienced an institutional vacuum in the absence of a constitutional court. In the face of this shortcoming, the Administrative Court sought to overcome the serious obstacles to the control of constitutionality by the ordinary judge and the recognition of constitutional principles outside the Constitution, which represent the legal reference to the protection of rights and of freedom.
