الملخص
الملخص : من بين الأهداف الناتجة عن الحوكمة ، تعزيز المناخ الاستثماري و رفع القدرة التنافسية و الحد من الفساد، وهو ما سعى المشرع الجزائري إلى تطبيقه في الصفقات العمومية بالنظر إلى الغلاف المخصص لها و الذي تسبب في انتشار كبير للفساد ، و لعل اعمال مبادئ الحوكمة في هذا النوع من العقود الإدارية لا يمكن تفعيله بشكل كبير في مرحلة التنفيذ لأن الصفقة تكون قد منحت لمتعامل معين، لكن الإشكال يطرح في اختيار هذا المتعامل أي في مرحلة إبرام الصفقة العمومية، و هو ما يعرف أكبر مجال للتلاعب و الانحراف ، لذلك تدخل المشرع و قيدها بمجموعة من المبادئ ، قد تعرف في بعض الأحيان استثناءات لكنها في حقيقة الأمر، تعد ضمانة أخرى لها، إلى جانب استحداث سلطة رقابية قضائية تمثل بدورها ضمانا للحوكمة. Abstract: Among the objectives of the corporate governance are the increase of the level of competitiveness and curbing corruption. The governance were applied in Algeria with regard to public transactions which are likely to be associated with of types such on governance corporate Applying corruption. administrative contracts cannot be effectively applied during implementation phase since deals might have already been set with a specific party. The problem lies in the selection of such party the stages of public deals finalization process where there are many possibilities of corruption and malpractices. The Algerian corporate governance plan has stated some governing rules and principles to control such things. The plan has also introduced a new regulatory and judicial authority to ensure and regulate the corporate governance.
