الملخص
تناولت هذه الورقة البحثية دور الوظيفة التفسيرية للقاضي الإداري في الموازنة بين النظام العام والحريات العامة، ذلك أن تفسير النصوص القانونية علم قائم بذاته، يخضع لقواعد وضوابط يجب احترامها، وتتجلى أهمية التفسير في السلطة الممنوحة للقاضي والتي تؤثر بشكل مباشر في حياة الأفراد وحرياتهم من جهة، والنظام العام من جهة أخرى، حيث منح المشرع القاضي سلطة تقديرية في كثير من المواضيع والمسائل وما على القاضي إلا أن يأخذ المبادرة فيأتي هنا دوره الايجابي في فهم وتفسير النصوص ثم تطبيقها. This research paper deals with the role of the interpretative function of the administrative judge In the process of balancing public order and public freedoms, since the interpretation of legal texts is a stand-alone science, subject to rules and regulations that must be respected, and the importance of interpretation is reflected in the authority granted to the judge, which directly affects the lives and freedoms of individuals on the one side, Public order, on the other side, where the legislator granted the judge discretionary authority in many topics and issues and the judge should only take the initiative comes here to play a positive role in the understanding and interpretation of texts and then applied.
