فكرة النظام العام البيئي المحلي و تطبيقاتها في التشريع الجزائري

الملخص
تعتبر فكرة النظام العام البيئي المحلي أمرا مبتكرا للغاية ،لم يترسب مضمونه في القانون الاداري إلا حديثا ، ازاء ما طرأ على المجتمع من تقدم تكنولوجي هائل وما ترتب عليه من آثار سلبية خطيرة اصابت البيئة التي نعيش فيها ، والتلوث الذي امتد لكل عناصر البيئة الطبيعية وغير الطبيعية، ولخطورة هذا التلوث على مستقبل الحياة بصفة عامة والحياة البشرية بصفة خاصة، ولعل القانون الاداري بما يتضمن من سلطات و امتيازات و قواعد آمرة ،هدفها حماية النظام العام ،يعد اكثر فروع القانون إتصالا بمكافحة تلوث البيئة، والضبط الاداري البيئي على وجه الخصوص بسلطاته المتعددة من أهم الوسائل تحقيقا لهذا الشأن . Abstract: The idea of the local public environmental system is very innovative, the content of which has been deposited in the administrative law only recently, because of the huge technological advances that have taken place in society and the serious negative effects that have affected the environment in which we live, and the pollution that extended to all elements of the natural and abnormal environment. And the seriousness of this pollution on the future of life in general and human life in particular, and perhaps administrative law, including the powers and privileges and rules peremptory, aimed at protecting public order, is the most relevant branches of law to combat environmental pollution, and environmental administrative control in particular its multiple authorities The most important means to achieve this.
