تطبيقات فكرة النظام العام البيئي في التشريع الجزائري

الملخص
يعد النظام العام البيئي تحول جديد في مضمون فكرة النظام العام نظرًا لأهمية موضوع البيئة في المجتمع، مما دفع المشرع الجزائري إلى تبني منظومة قانونية تتضمن مجموعة من الآليات والوسائل المقررة لصالح السلطات المختصة بهدف الحد من المشكلات البيئية، ويهدف الباحث من خلال هذه الدراسة إلى استعراض مختلف تطبيقات فكرة النظام العام البيئي في التشريع الجزائري ومدى فعاليتها في تكريس حق الفرد في العيش في بيئة سليمة وخالية من الملوثات، وقصد معالجة الموضوع في مختلف جوانبه تمّ الإعتماد على المنهج الوصفي التحليلي المناسب لهذه الدراسة، وتمّ التوصل في الختام إلى عدة نتائج أهمها إعتماد الأسلوب الوقائي لتحقيق أهداف السياسية البيئية لاسيّما من خلال نظام الترخيص الإداري، إضافة إلى ضبط نشاط المنشآت المصنفة بإعتبارها تشكل مصدر حقيقي للتلوث، مع تطبيق آلية الجباية البيئية وفق مبدأ الملوث الدافع، وهو ما من شأنه المساهمة في حماية البيئة. The public environmental order is a new shift in the content of the idea of public order due to the importance of the environment subject, which led the Algerian legislator to adopt legal system that includes a set of mechanisms which set in the benefit of the authorities to reduce environmental problems. the researcher aims to review the various applications of the idea public environmental order in Algerian legislation and their effectiveness in enshrining the right of the individual to live in a healthy and pollutant free environment, In order to address the issue in all its aspects, we have relied on the descriptive and analytical method, In conclusion, several results were reached, the most important is the adoption the preventive method to achieve the objectives of the environmental policy, especially through the administrative licensing system, in addition to controlling the activity of establishments classified as a real source of pollution, with the application of environmental collection mechanism, which would contribute to environment protection.
