حماية الأراضي الفلاحية في القانون الجزائري بين النظرية والتطبيق

الملخص
حظيت الأراضي الفلاحية في القانون الجزائري بالحماية القانونية اللازمة لمنع التعدي عليها بأي شكل من الأشكال أو تحويلها عن طابعها الفلاحي لاسيما في قانون التوجيه العقاري رقم 90-25، وقانون التوجيه الفلاحي رقم 08-16. إلا أن الواقع أثبت خلاف ذلك، حيث تم التعدي على هذه الأراضي بغير وجه حق، سواء من طرف الأفراد أو من طرف مؤسسات الدولة، وذلك باستعمالها لأغراض البناء، مما أدى إلى تغيير وجهتها الفلاحية خلافا للقانون. La protection des terres agricoles est garante par la loi algérienne en vue d’empêché leur utilisation à dés fins autres que ceux par lesquelles elles sont vouées, Aussi, la loi d’orientation foncière N° 90-25, et la loi relative à l’orientation agricole N° 08-16, comprennent assez de disposition juridiques destinées à asseoir une protection suffisante du parc agricole national. Toutefois, la multiplication des mécanismes de protection n’a pas suffit pour préservé la mutation des terres agricoles de leur destination naturelle. Leur exploitation dans des projets relevant des secteurs de l’habitant et des travaux publics est flagrante. Une situation qui exige une réaction rigoureuse et rapide de la part de l’Etat afin d’arrêter cette saignée et empêcher le rétrécissement continuel du parc agricole nationale. The protection of the agricultural Fields by the algerian law with the purpase of enabling their use for purpases ather than their original goals. In fact the orientation law of the buildings mumber 90-25 and the law of agricultural orientation mumber 08-16 implied enaugh of articles to protect the naturel agricol field. Whereas, the multiplication of the protection mechauisems are not enaught to maintain the transformations of the agricultural fields from their natural purpase. Their use in the areas if habitation projects and public works (constructions) is obirons. This situation requires a fast réaction and strong reaction in the same time from the state, which lead to change it’s agricultural nature and reduce the national agricultural field (space).
