قواعد العدل الإنساني الإسلامي في العلاقات الدولية في زمن السلم

الملخص
ملخص تتناول الدراسة لقواعد العدل الإنساني في العلاقات الدولية إبان مرحلة السلم و تعرض لتلك القواعد ؛ استنادا لفكرة أن الأًصل في العلاقات الدولية السلم ،كما تتعرض إلى أبرز قواعد العدل الإنساني في زمن السلم كقاعدة التعاون الإنساني وحسن الجوار في النظام الإسلامي، وقاعدة حفظ الكرامة الإنسانية، وقاعدة حفظ حقوق الأقليات، وقاعدة رفض فرض سياسة الأمر الواقع في العلاقات الدولية. ثم تبين الدراسة أثر تلك القواعد في العلاقات الدولية، ومن أبرز ما خلصت له الدراسة أن النظام الإسلامي يقدم نظرة شاملة تتمثل في قيم تجسد الرقي في إعمال إعلاء مكانة الكرامة الإنسانية وترسيخا لقواعد العدل الإنساني ومبدأ الحق والتقوى والبر والإحسان في معاملة حتى العدو، فالقوة لا تبرر هضم حقوق الآخرين، ويترتب على ذلك جواز ابرام العلاقات مع الدول التي لم تعادي المسلمين فالأصل في العلاقات الدولية في الإسلام السلم المشروط باستيفاء الحقوق والعدل بخلاف الإذعان، فالبشرية تميل إلى المدنية والاجتماع في مناخ ملائم يسوده السلم والتفاهم بين الدول، واحترام خصوصيات الشعوب، ولم ينزع المسلمين للحرب إلا مضطرين لأسباب يفرضها المنطق استجابة لكل واقعة على حده.
