ملخص: يركز موضوع هذا البحث على التخلي عن الوظيفة (المنصب) في الخدمة العمومية في الجزائر. كما أنها محاولة جدية لوضع ثقل على أهم آليات المرسوم التنفيذي رقم 17-321 الذي يحدد شروط وضع الموظف في حالة التخلي عن المنصب ، وتم الاستناد في هذا البحث أكثر على الجانب القانوني لتوضيح الأفكار القائمة على حقائق والتي تثبت أن كل موظف عمومي ، سواء كان ينتمي إلى الخدمة المدنية للدولة ، إلى الخدمة العامة الإقليمية ، سواء كان موظفًا عامًا أو متدربًا أو وكيلًا ، إما بدوام كامل أو جزئي ،فإنه معني بالقواعد (ولو بشكل نسبي) المتعلقة بالتخلي عن الوظائف في الخدمة العامة. Abstract: The subject of this research mainly concerns the abandonment of a post in the public service in Algeria. It is also a serious attempt to put the weight on the most important mechanisms of Executive Decree No. 17-321 setting the terms of dismissal of the official for abandonment of post. I am based in the present research much more on the side legal basis for the authentication of ideas that are based on realities that proves that Every public official, whether he belongs to the state civil service, to the territorial public service, whether he is a public servant, trainee, or agent non-public law holder, either full-time or part-time, is subject to the rules on the abandonment of posts in the public service.
