La Cyber Justice En Algérie: état Des Lieux Et Perspectives

Résumé: LA CYBER JUSTICE Ces dernières années, le monde judiciaire algérien a connu d’importants changements dus à l’introduction de l’informatique dans la gestion de la justice: l’accès public en ligne, aux données des affaires en réseau, bornes d’accueil et d’information pour les justiciables. L’emploi des technologies informatiques dans l’administration de la justice n’est pas nouveau mais il est de plus en plus répandu dans le monde en raison des solutions qu’il apporte aux problèmes qui entravent la marche de la justice: réduction du temps et de la qualité du travail, économie des ressources… L’époque moderne connait un important mouvement international prônant la résolution des conflits par le biais de l’internet visant en premier lieu, les litiges du cyber espace. Cette nouvelle forme de justice administrée au moyen de l’internet ou cyber justice est une alternative à la justice étatique algérienne et constitue une solution aux multiples problèmes qui entravent sa bonne marche. La cyber justice en Algérie n’est pas une simple fiction, elle peut devenir une réalité si les obstacles juridiques de la mise en place de la justice du futur sont levés. This new form of justice administered through the internet or cyber justice is an alternative to the Algerian state justice and a solution to the many problems that hinder its smooth running. Cyber justice in Algeria is not a mere fiction, it can become a reality if the legal obstacles to the establishment of justice of the future are raised. العدالة عبر الانترنت شهد القضاء الجزائري في السنوات الأخيرة تغيرات هامة، نتيجة إدخال نظام المعلوماتية على إدارة العدالة: التحاق عام بالأنترنت، بمعطيات القضايا في شبكاته، محطات الاستقبال والمعلومات بالنسبة للمتقاضين. . . إن استعمال تكنولوجيا نظام المعلوماتية في إدارة العدالة ليس بالشيء الجديد بل واسع الانتشار في العالم بسبب الحلول التي يوفرها للمشاكل التي تعيق سير العدالة: توفر الوقت والجودة في العمل وكذا الاقتصاد في الموارد. عرف العصر الحديث حركة دولية هامة تدعو إلى حل النزاعات عن طريق الأنترنت وبالدرجة الأولى نزاعات الفضاء الإلكتروني. إن الشكل الجديد للعدالة الذي يسير عن طريق الأنترنت أو العدالة الإلكترونية هو بديل للعدالة الجزائرية ويشكل حلا لمشاكل عديدة التي تعيق سيره الحسن. العدالة الإلكترونية بالجزائر ليست مرد خيال، بل بإمكانها أن تصبح واقعا إذا أزيحت العقبات القانونية لإنشاء عدالة الغد.
