قراءة في النصوص التشريعية المتعلقة بالمؤسسة المتحفية بالجزائر

الملخص
تعاني المتاحف الجزائرية من ضعف وفشل التسيير الإداري، والتي لم تعرف تنظيما تشريعيا إلا سنة 1985، وهو تاريخ صدور القانون النموذجي للمتاحف حيث خضعت المتاحف الوطنية في الجزائر إلى أحكام المرسوم رقم 85-277 المؤرخ في 29 صفر 1406هـ الموافق ل 12 نوفمبر سنة 1985 "يحدد القانون الأساسي النموذجي للمتاحف الوطنية " وشكل هذا المرسوم الانطلاق الفعلي للتسيير الذاتي للمتاحف الوطنية ليتم إلغاءه سنة 2007، بناءا على صدور المرسوم رقم 07-160 المؤرخ في 10 جمادى الأول 1428هـ الموافق ل 27 مايو سنة 2007 "يحدد شروط إنشاء المتاحف ومهامها وتنظيمها وسيرها" ويتم إلغاء هذا المرسوم كذلك بعد أربع سنوات فقط من صدوره، وذلك على إثر إصدار المرسوم الجديد رقم 11-352 المؤرخ في 07 ذي القعدة 1432 الموافق ل 05 أكتوبر سنة 2011 "يحدد القانون الأساسي النموذجي للمتاحف ومراكز التفسير ذات الطابع المتحفي". وقد حافظ المشرع على نفس النص تقريبا من 1985 إلى 2011 غافلا في كل إصدار على الجانب التقني في تسيير وحفظ المجموعات المتحفية، وبشكل عام لم تعكس هذه التشريعات حاجة المتحف الجزائري، حيث ورغم توالي صدور المراسيم المتحفية إلا أنها لحد اليوم لا تواكب متطلبات المتحف المعاصر. Algerian museums suffer from weakness and the failure of the administrative management, which did not know the regulated legislatively, but in 1985, the date of the issue of Model Museums law where undergone national museums in Algeria to the provisions of Decree No. 85-277 dated 29 Safar 1406 corresponding to November 12 of 1985 "sets Basic Law Model National Museums "and the form of this decree the actual starting of self-management of national museums to be cancelled in 2007, based on the issue of Decree No. 07-160 dated 10 June 1428, corresponding to May, 27, 2007" defines the conditions for the establishment of museums, functions and organization and the functioning "and are as well as the abolition of the decree only four years after its release, and that, following the issue of the new Decree No. 11-352 dated 07 November with a 1432 corresponding to October 5th 2011 "Basic Law defines the Model Museums and interpretation centers nature museum". The legislator has kept the same text almost from 1985 to 2011 unaware of each version on the technical side in the management and conservation of museum collections and in general this legislation did not reflect the need for the Algerian Museum, where despite the succession of the issue of the decrees museum they ,till today, are not aligned with the contemporary museum requirements
