دور منظمة التجارة العالمية في تكريس مبدأ التدخل المشروع في الشـــؤون الداخليــة للدول

الملخص
تعد منظمة التجارة العالمية من أهم وأخطر أدوات العولمة المعاصرة التي عهد إليها مهمة تحرير التجارة الدولية من القيود المفروضة على انسياب السلع. وعلى الرغم من حداثتها، إلا أنها في الوقت نفسه تسببت في إظهار تأثيرات وانعكاسات كبيرة على مبادئ القانون الدولي وأهمها مبدأ عدم التدخل في الشؤون الداخلية للدول الذي نص عليه ميثاق الأمم المتحدة في الفقرة السابعة من المادة الثانية، ولذلك يجب احترامه وعدم المساس به سواء من جانب الدول أو المنظمات الدولية بوصفه أحد المبادئ الأساسية للعلاقات الدولية المعاصرة. إلا أن الاتفاقية المنشئة لمنظمة التجارة العالمية لم تتعرض صراحة لهذا المبدأ، ومن الناحية العملية، لا يمكن القول أن منظمة التجارة العالمية تلتزم بمبدأ عدم التدخل في الشؤون الداخلية، بل هي على عكس ذلك أصبحت تتدخل وبشكل مشروع في الشؤون الداخلية للدول الأعضاء من خلال تنفيذ ما يسمى باتفاقيات تحرير التجارة العالمية. Summary The world organization is one of the most important contemporary globalization entrusted with the liberalization of the International trade mission of the restriction of the flows of goods. Aithough the novelty of the World Trade Organization and ist importance in the development of the world trade it revealed the impacts and huge consequences on the international law concepts. the most important one is the non interference in states intrenal affairs stipulated by the United Nations treaty in the seventh paragraph of the second Article. Therefore , it must be respected and not compromised, either by states or intrenational organization, as one of the basic concepts of the contemporary international relations. Except that the convention establishing the World Trade Organization did not mention this concept, in fact we can’t say that the World Trade Organization is committed to the non- interference in the states internal affairs concept.It is rather the oppsite. Nowadays, it interferes legitimately in the member stats intrenal affairs by executing the conventions of the liberalization of the world trade.
