حمــــاية الأســرة من جريمة الإهمـــال الأســـري

الملخص
عالجت الدراسة الحماية الجنائية للأسرة من الإهمال ردعًا لأي مساس بأمن وطمأنينة الأسرة فقد اهتم المشرع بضمان احترامها وعدم التعدي على حقوق أفرادها عن طريق تجريم ترك الأسرة أو ما يعرف بجريمة الإهمال العائلي، ونظرًا لأهمية حماية الأسرة خصّص المشرع لهذه الجريمة قسم خاص بها وهو القسم الخامس من الفصل الثاني من الباب الثاني في قانون العقوبات تحت عنوان "ترك الأسرة"، وتتضمن أربعة صور وردّت في المادتين 330 و331 من قانون العقوبات الجزائري وهي، ترك مقر الأسرة، ترك الزوجة الحامل، الإهمال المعنوي للأولاد، الامتناع عن تسديد النفقة المقرّرة قضاءً. وعليه تم تركيز الدراسة حول هذه الصور التي نصت عليها المادتان المذكورتان أعلاه، بالتطرق إلى الأحكام الموضوعية والإجرائية التي تحكم الإهمال الأسري. The study deals with the criminal protection to the family from neglect to deter any prejudice to the security and tranquility of family was interested in the legislature to ensure respect for and non-infringement on the rights of its members by criminalizing leaving the family, or what is known as the crime of parental neglect, and given the importance of protecting the family devoted legislator for this crime has its own section of the fifth section of the Chapter II Part two of the Penal Code under the title "the family left," and includes four images contained in articles 330 and 331 of the Algerian Penal Code which leaving family's headquarters, leaving a pregnant wife, moral neglect for children, to refrain from paying alimony planned to spend. That why the study was about these images, which are stipulated in articles States mentioned above focus, addressing the substantive and procedural provisions of family neglect controllers
