مدى مشروعية التجارب الطبية على الإنسان

الملخص
ملخص: تعتبر التجارب الطبية من التدخلات الطبية التي لا يمكن اجتنابها لتقدم العلوم الطبية، التي بفضلها استطاع العلماء الحد من الكثير من الأمراض، والتجارب الطبية نوعان: تجربة علاجية والتي يقصد بها علاج المريض، وتجربة علمية تجرى على إنسان أو على مريض دون ضرورة تمليها حالته االصحية، وإنما لإشباع شهوة علمية، ورغم أهمية هذه التجارب إلا أنها كانت ولا زالت محل خلاف حول مشروعيتها، تشريعيا، قضائيا وفقهيا. Résumé : Les expériences médicales, étant des interventions incontournables dans le développement des sciences médicales, ont permis aux scientifiques d’éliminer plusieurs maladies. Il existe deux genres d’expérimentations médicales; expérimentations thérapeutiques, qui consiste à soigner le patient, la deuxième dite expérimentations scientifiques, laquelle consiste à accomplir des interventions sur l’être humain ou sur le patient sans pour autant qu’elles soient exigées par une nécessité sanitaire quelconque, mais tout simplement pour assouvir une appétence scientifique. En dépit de l’importance de ces expérimentations, elles font toujours l’objet d’une polémique quant à leur légalité, tant législative que jurisprudentielle, voire doctrinale. Abstract: Medical experiments considered essential interventions in the development of medical sciences, have allowed scientists to eliminate several diseases. There are two types of medical experiments; therapeutic experiments, which consists in treating the patient, the second so-called scientific experiments, consists in fulfilling interventions on the human being or on the patient as far as they are demanded by any sanitary necessity, but simply to satiate a scientific appetite. In spite of the importance of this experimentation, they always make the object of a debate as for their legality, so legislative as judicial, or even doctrinal.
