الكتب المعتمدة في الحكم والفتوى في المذهب المالكي

الملخص
الملخص: يتناول هذا البحث موضوع: "الكتب المعتمدة في الحكم والفتوى في المذهب المالكيّ"، حيث تمّ تقسيمه إلى مبحثين، ومن خلال المبحث الأوّل تطرّقت إلى مفهوم الحكم والفتوى في اللغة والاصطلاح، مع بيان أوجه الاتفاق والاختلاف بينهما، ثمّ بيّنت الأصل الذي كانت عليه الفتوى قبل أن تنتقل إلى الكتب المعتمدة، ومن ثَمَّ اتفاق العلماء على جواز ذلك، ثمّ ذكرت شروط اعتماد الكتب في المذهب المالكيّ، وطريقة ثبوت كلّ شرط منها. وأمّا المبحث الثاني فقد تطرقت فيه إلى نماذج من الكتب المعتمدة في المذهب المالكيّ، وجعلتها على قسمين: الكتب المعتمدة من غير مختصر خليل وشروحه في قسم، ومختصر خليل وشروحه المعتمدة في قسم آخر، وميّزت مختصر خليل عن باقي الكتب لشهرته وانعكاف المالكية عليه. Summary This study deals with the subject of "The books adopted in the rule and fatwa in the Maliki school", where it was divided into two sections, and through the first topic touched on the concept of governance and fatwa in language and terminology, with the statement of the differences and differences between them, and then showed the origin of the fatwa before To move to the approved books, and then the scholars agree on the permissibility of it, and then mentioned the conditions of the adoption of books in the Maliki school, and the method of proving each of them. As for the second topic, I have touched upon examples of the books adopted in the Maliki school, and made them in two parts: the books of the author of the uncut Khalil and his annotations in the section, and the abbreviation Khalil and his annotations adopted in another section, and summarized Khalil's summary of the rest of the books for his fame.
