وسـائل الضبط الإداري واجـراءاتـه كسبيـــل لتحقــيق الأمـــن البيئي

الملخص
بما أن هدف الضبط الإداري هو حماية النظام العام بعناصره الثلاثة (الأمن العام، الصحة العامة، والسكينة العامة)، كان لزاما على المشرع أن يجعل له وسائل فعالة لتحقيق هذه الغاية الضرورية، والتي يؤدي تحقيقها إلى منافع كبيرة تمس حياة الانسان، ولتوفير بيئة حسنة وملائمة لعيش هذا الأخير، تستعمل الإدارة الكثير من الوسائل السابقة والاجراءات التي تضمن حماية البيئة (تربة، ماء، هواء) وتعمل على تحقيق الأمن البيئي، حيث تتنوع هذه الوسائل والاجراءات بين القبلية الوقائية منها على غرار الأنظمة واللوائح والترخيص، والتحفيز والبعدية العلاجية مثل الأوامر والقرارات الفردية والتنفيذ الجبري وغيرها، وبالنظر الى الدور الكبير الذي تلعبه هذه الاجراءات في توفير الحماية للبيئة، فلا يكاد يختلف اثنان حول ضرورة تطويرها وتفعيلها الدائم لتفادي التلوث والعمل على تحقيق الأمن البيئي. Since the goal of the administrative control is to protect the public order with its three components (public security, public health and public tranquility), the legislator has to make effective means to achieve this necessary goal, which results in significant benefits to human life and to provide a good and appropriate environment, and in order to live the latter, the administration uses many of the previous methods and procedures that guarantee the protection of the environment (soil, water, air) and works to achieve environmental security. These methods vary between preventive tools such as regulations, licensing, and implementation of individual and forced others, and given the significant role played by these measures in the protection of the environment, there is hardly any different between two about the need to develop lasting and activated procedures to avoid contamination and to achieve environmental security.
