الملخص
الملخص: يعتبر العنف من الظواهر الاجتماعية القديمة، حيث كانت بدايته باعتداء قابيل على أخيه هابيل، باستعمال العنف اللفظي المتمثل في التهديد والوعيد بالقتل، ثُمَّ أتبعه بالعنف الجسدي الذي كانت نهايته قتل أخيه، وبقي العنف سلوكا هجينا لا يخلو منه أي مجتمع، كما تنوعت أشكاله حيث يشمل الإيذاء الجسدي، واللفظي، والنفسي، والاستغلال الاقتصادي، والحرمان الصحي، والاعتداء الجنسي، حيث يحاول بعضهم إيجاد مُسَوِّغٍ لهذا العنف بربطه بالدِّين، والتقاليد والأعراف الاجتماعية، أو الرجولة، أو كون الزوج مسئولاً عن زوجته وأولاده، ومن ثَمَّ يحقُّ له ممارسة العنف ضدهم، حيث أصبحت دراسة ظاهرة العنف الأسري، والعوامل المساهمة في إيجاده في غاية الأهمية، باعتبار العنف الأسري ظاهرة اجتماعية، من شأنها أن تؤدي إلى ظهور مشكلات تصيب أفراد المجتمع، وتنجم عنها أضرار كثيرة، إذ من انتشار العنف بشتى أشكاله في الأسرة يجعل أفراد المجتمع في اضطراب، وفوضى تفقدهم الشعور بالأمن، والاستقرار، مما يؤثر سلبًا على أفراد الأسر والمجتمع، وفي هذا المقال محاولة لاستجلاء العنف الواقع على المرأة، انطلاقًا من بيان مفهومه، وأشكاله، مع ذكر أسبابه، وأصناف النساء اللاتي يتعرضن للعنف، وتقسيم العنف باعتباره جريمة يعاقب عليها القانون إلى جناية وجُنحة حسب العقوبة المقررة له، وذلك بتحليل المواد المضافة في قانون العقوبات الجزائري، وبيان مدى نجاعتها للحد من هذه الظاهرة، ثم ختم المقال بأهم النتائج المتوصل إليها. Abstract: Violence is regarded as an ancient social phenomenon, started with Cain’s assault on his brother abel, using verbal violence representing threat and menace with murder, then it was followed by physical violence that ended up with killing his brother, and violence a hybrid behavior prevailing in any society, it took various forms including physical, verbal, psychological and economic exploitation, medical deprivation, sexual assault, where some people try to find a justification to this violence by selecting it to religion, traditions and social customs, or manhood, or a husband being responsible of his wife and children, and then being given the light to practice violence against them, where the study of family violence phenomenon and the factors leading to it have be come so important, regarding family violence as a social phenomenon that can engender problems to community members, resulting many damages, as spread of various types of violence in a family can make community members in disorder and chaos that make them lose the feeling of security and stability, which can have a bad influence on community members and society, and in this article, there 's an attempt to explain the violence practiced on women, starting with its definition, its forms, stating its reasons and the different women who were exposed to violence, and dividing violence as it is considered a crime punished by the law to a felony or a misdemeanor according to the punishment set to it, and that by analysing the articles added to the algerian law of punishments, showing the extent of its effectiveness to limit this phenomenon, after that , concluding this article with the most important reached results.
