حماية القيم التقليدية في القانون الدولي

الملخص
تعتبر حماية "القيم التقليدية" من القضايا المعاصرة في القانون الدولي، خاصة بعد ظهور اتجاه جديد يطالب بإعادة النظر في القيم التقليدية الأساسية والتي تعد الأساس في بلورة حقوق الإنسان على المستوى الوطني والقومي والدولي وتعد الأساس أيضا في وجود البشرية جمعاء. وتلعب "القيم التقليدية" دورا مهما في توحيد جميع البلدان والشعوب، وليس لتفريقها. وقواعد حقوق الإنسان ومعاييرها، تقوم على القيم التقليدية للبشرية. إن إدراك وضمان الصلات القائمة بين القيم التقليدية وحقوق الإنسان يساعد على تقوية الاحترام العالمي لحقوق الإنسان والاعتراف بطبيعتها العالمية. تكمن أهمية هذا الموضوع في ضرورة العمل الجاد من أجل الحفاظ على هذه القيم التقليدية وترسيخها وإعطائها قوة إلزامية واستخدامها كوسيلة لمواجه تلك الدول التي تحاول أن تفرض على الدول الأخرى والمجتمع الدولي قيم ومعاير والمسمى بالقيم الغير تقليدية والتي يصعب تبنيها في كثير من الدول لأنها تتناقض مع ثقافاتها وعاداتها والدين المتبع في هذه الدول، ومن هذا المنطلق أصبح البحث في هذا الموضوع جدير بالاهتمام لدى الفقه القانوني الدولي. Abstract: The protection of "traditional values" is one of the contemporary issues in international law, especially after the emergence of a new trend called for the revision of the traditional values which are the foundation in the development of human rights at the national and international level and also basis of the existence of the whole humanity. "Traditional values" play an important role in the unification of all countries and people، not to divide them. The norms and standards of human rights are based on the traditional values of humankind. To recognize and ensure the linkages between traditional values and human rights helps to strengthen universal respect for human rights and the recognition of the universality of human rights. The importance of this subject in the need to work hard in order to maintain these traditional values, consolidating and give it the power of mandatory and use it as a means of facing those trying to impose on other countries and the international community's values and standards, called the values of non-conventional and which are difficult to be adopted in many countries because they are contrary to their cultures and traditions and religion followed in these countries, and from this point of research on this subject is worthwhile in the international jurisprudence has become. Human rights must serve as an instrument to unite all countries and peoples, not to divide them. In determining the common elements, we must acknowledge the moral significance of human rights norms and standards, recognizing that they are underpinned by the traditional values of humankind. Human rights should not be explained solely in terms of their legal interpretation, with mention only of violations and the resultant sanctions. To achieve universal observance of human rights, it is particularly important to promote a culture of respect for human dignity, freedom and human rights at all levels.
