المال العام بین إشكالیة الملكیة ووجوب الزكاة علیھ الجزائر نموذج

الملخص
الملخص: تعتبر إشكالیة المال العام أحد المواضیع التي حازت على اھتمام العدید من العلماء والباحثین في العصر الحالي، إذ كانت معظم بحوثاتھم تدور حول الخلاف في الشروط التي تجب على المال المزكى خصوصا شرط ملكیة المال. فھل ھذه الشروط (ملكیة المال) لھا دلالة شرعیة حتى نمنع الزكاة على ھذا النوع من المال أم أن مصلحة الحالة الاجتماعیة التي یعیشھا الأفراد ھي التي تحكم في ھذه المسألة؟ فبإسقاط ھذه الإشكالیة على الواقع الاجتماعي الجزائري فإنھ یفرض وبحتمیة زیادة النفقات من أجل موازنة اجتماعیة بدلا من موازنة اقتصادیة. فلا یمكن أن تكون دولة ذات احتیاطِ صرف وذھب مع وجود أزمات اجتماعیة حادّة كأزمة الفقر والبطالة والسكن. لذلك أصبحت الضرورة ملحة لإحیاء ھذه الشعیرة المفقودة في الدول الإسلامیة وھي زكاة المال العام أو زكاة الركاز The problematic public money, is considered one of the topics that have gotten the attention of many scientists and researchers in the current era, as were most their researches about the dispute around the conditions about the money approved, especially, money ownership requirement. The question is : are these conditions (ownership of money) have significant legitimacy even prevent Zakat on that kind of money? or that the social situation of individual interests, is the governer in this matter?. When we relate this problem with the Algerian social reality, so , it imposes with inevitability the increase of expenditures. The principal ai mis an economic balance rather than social one. We can’t have a country of exchange and gold reserves with an acute social crisis as poverty, unemployment and housing. This is why it has become an urgent necessity to revive this lost ritual in Muslim countries, which is «Zakat of public money or Zakat of Rikaz».
