الملخص

جاءت هذه الدراسة كاشفة للمقتدى بهم في القضاء والفتوى ببلاد توات وهم يستندون إلى أصل ما جرى به العمل في العملية الترجيحية، ومن خلالها تمكن الباحث من صناعة درس نظري في العمل التواتي، حدد به مفهومه وجلى به أنواعه وضوابطه عند أعلام مدرسة توات المالكية وفق منهج استقرائي تحليلي، وبأسلوب بياني سهل واضح لا غموض فيه، وقصده من ذلك كله إلى إبراز المرتبة الاجتهادية لفقهاء مدرسة توات المالكية، وإثبات أن لهم عمل الخاص بهم وأن الاجتهاد المذهبي ظل بابه مفتوحاً بالمدرسة المذكورة. This study is trying to shed light on those who are the examples in the judiciary and the Fatwa in Tawat area. The study based on the origin of what was done and usedin terms of weighting process. The result is to have a theoretical lesson in Tawat works through defining its concept and clarifying its types and controls among the Pioneers of the Maliki school of Tawat using an inductive and analytical approach in an easy and clear graphic style. The aim of this work is to highlight the jurisprudential rank of the jurists of the Tawat Maliki school and to prove that they have their own work. Thus the doctrinal jurisprudence remained always opened in this school.
