الملخص
ملخص: يهدف هذا المقال إلى الكشف عن جهود السعدي في توسيع أوعية الاجتهاد المقاصدي؛ عن طريق إحياء أو تجديد إناطة الأحكام بحكمها أو بمقاصدها، بدل إناطتها بعللها، أو أوصافها الظاهرة، وذلك من خلال توسيع القياس الأصولي؛ الذي أصبح عنده بمعنى العدل والميزان، الذي لا يوجد في الشريعة ما يتعارض معه؛ لا في الأصول، ولا في الفروع. فالشريعة لا تفرق بين المتماثلات، ولا تجمع بين المختلفات؛ وهي بهذا متكاملة ومنسجمة بين دلائلها ومسائلها، بين كلياتها وفروعها، باطنها وظاهرها، وبين مصالحها ونصوصها. Abstract: This article aims to reveal Al-Saadi’s efforts to widen the ways of “Purposeful Ijtihad” via reviving or renewing the assignment of judgments to their objectives by expanding fundamental analogy instead of linking them to their causes, or their evident descriptions. This has become his reference to justice and balance that nothing in the Sharia contradicts them, neither in roots nor in branches. The Sharia neither discriminates between similar ones nor does it combine the different ones; thus, it is integrated and harmonious in terms of evidences and issues, roots and branches, interior and its exterior, and objectives and texts.
