الحماية القانونيّة للمصنّف السّمعيّ البصريّ في ظلّ التّشريع الجزائريّ

الملخص
ملخّص: تنقسم حماية حقوق المؤلّف والحقوق المجاورة على المستوى الوطنيّ إلى شقّين أساسيّين: أحدهما مدنيّ والآخر جنائيّ؛ يتعلّق الأول بالمسؤوليّة المدنيّة لمن يتعدّى على أيّ حقّ من حقوق المؤلّف الأدبيّة والماديّة، أمّا الثّاني فيخصّ المسؤوليّة الجنائيّة عن أعمال التّقليد ومعاقبة مرتكب أيّ فعل من أفعال التّقليد. ونظرا للاعتداءات الّتي تقع على المصنّفات الأدبيّة والفنّية وحقوق التّأليف، خاصة مع التّطور الحاصل في مجال الإنتاج السّمعيّ البصريّ، ارتأينا البحث عن آليّات قانونيّة لحماية المصنّفات السّمعيّة البصريّة في ظلّ التّشريع الجزائريّ، منذ أوّل خطوة من ابتكارها إلى غاية استغلال الحقوق المترتّبة عليها بشرط تمتّعها بالأصالة، وهو ما قام به المشرّع الجزائريّ من خلال سنّ قانون لحماية هذه المصنّفات، وذلك بموجب أحكام الأمر رقم 03-05 المؤرّخ في 19 جويلية 2003 المتعلّق بحقوق المؤلّف والحقوق المجاورة. Abstract: The protection of copyright and related rights at the national level is divided into two basic parts: one civil and the other criminal. The first relates to the civil liability of anyone who infringes on any of the author’s literary or material rights, while the second concerns criminal liability for acts of imitation and the punishment of the perpetrator of any act of imitation. In view of the attacks occurring on literary and artistic works and copyrights, especially with the development taking place in the field of audiovisual production, we decided to search for legal mechanisms to protect audiovisual works under Algerian legislation, from the first step of their creation until the end of exploiting the rights resulting from them, provided that they are original. This is what the Algerian legislator did by enacting a law to protect these works, in accordance with the provisions of Order No. 03-05 of July 19, 2003 relating to copyright and related rights.
