جريمة الحيازة غير المشروعة للعتاد الحربي والأسلحة والذخيرة في التشريع الجزائري

الملخص
تهدف هذه الدراسة إلى البحث في الصور التي حددها المشرع الجزائري للحيازة غير المشروعة للعتاد الحربي والأسلحة والذخيرة من خلال تحليل نصوص الأمر97/06 المتعلق بالعتاد الحربي والأسلحة والذخيرة، واستخلاص أركان وصور جرائم الحيازة غير المشروعة للعتاد الحربي والأسلحة والذخيرة والعقوبات المقررة لها،وقد توصلت الدراسة إلى النتائج التالية وهي: أن قانون العتاد الحربي والأسلحة والذخيرة يعد أحد القوانين الجزائية الخاصة والمكملة لقانون العقوبات وهو قانون عقابي يحتويتجريمالمجموعة من الأفعالكحمل الأسلحةوالذخائر وحيازتها أو استيرادها أو تصديرها أو الإتجار بها أو بيعها أو تخزينها أو نقلها من مكان إلى آخر بدون رخصة. وهو قانون تنظيمي في الان ذاته لأنه يقوم بتنظيم كل ما يتعلق بحمل العتاد الحربي والأسلحة والذخيرة وحيازتها، ويبين من هي الجهات التيبإمكانها تصنيع واستيراد وتصدير ونقل وتوزيع الأسلحة والذخيرة وينظم منح التراخيص ويبين عدد الأسلحة الجائز ترخيصها ويمنع حيازة وترخيص أنواع أخرى من الأسلحة كالبنادق الحربية. كلمات مفتاحية: جرائم الحيازة غير المشروعة، العتاد الحربي،الأسلحة والذخيرة، القوانين الجزائية الخاصة، الأمر97/06. Abstract: This study aims to investigate the forms specified by the Algerian legislator for the illegal possession of military equipment, weapons and ammunition by analyzing the texts of Order 97/06 relating to military equipment, weapons and ammunition, and extracting the elements and forms of the crimes of illegal possession of military equipment, weapons and ammunition and the penalties prescribed for them. The study concluded that The following results are: The Military Equipment, Weapons and Ammunition Law is one of the special penal laws that complement the Penal Code. It is a punitive law as it includes criminal acts such as the crime of carrying, possessing, importing, exporting, trading, selling, storing or transporting weapons and ammunition from one place to another without a license. . And regulatory at the same time, because it regulates the carrying and possession of military equipment, weapons, and ammunition, and determines the entities that can manufacture, import, export, transport, and distribute. It regulates the granting of licenses, determines the number of weapons that may be licensed, and prohibits the possession and licensing of some types of weapons, such as military rifles.
