شهادة الحيازة كآلية لحماية الحيازة في ظل النظام الشخصي العقاري

الملخص
الملخص: نظرا لإتساع رقعة مساحة الاراضي التي لم تمسها عملية المسح العقاري، وحتى يمكن السير نحو تطهير شامل للملكية العقارية الخاصة، لجأ المشرع الجزائري عن طريق القانون رقم 90-25 المتضمن التوجيه العقاري الى دفع المواطنين الذين يحوزون أراضي بالمناطق التي لم تشملها بعد عملية المسح العقاري للحصول على سند حيازي، يسمى " شهادة الحيازة"، والمستحدثة بموجب المادة 39 من قانون التوجيه العقاري، وهذا قصد المساهمة ولو بصفة غير مباشرة في تكوين السجل العقاري ومجموعة البطاقات العقارية المزمع إنجازها في إطار مسح الأراضي العام. فإذا استوفى الحائز كل الشروط الضرورية للحصول على شهادة الحيازة، كان بإمكانه مباشرة إجراءات الحصول على شهادة الحيازة التي تضمنها المرسوم التنفيذي رقم 91-254 المحدد لكيفيات إعداد شهادة الحيازة وتسليمها، هذه الأخيرة تثير عدة نزاعات من خلال المكنات القانونية التي تخولها لصاحبها قد تضر بالمالك الحقيقي عند ظهوره، فقد يؤول إختصاص الفصل إلى القضاء العادي أو إلى القضاء الإداري. Abstract : Due to the large amount of land that has not been touched by the real estate survey process, and in order to move towards a comprehensive clearance of private property, the Algerian legislator, through Law No. 90-25, which includes real estate guidance, has paid citizens who have land in areas not yet covered by the real estate survey. On the basis of a title deed, called the "Certificate of Possession", which is created under Article 39 of the Real Estate Directive Law, which is intended to contribute indirectly even to the formation of the real estate register and the group of real estate cards to be completed within the framework of the Public Land Survey. If the holder has fulfilled all the necessary conditions for obtaining the certificate of possession, he or she may have commenced the procedure for obtaining the certificate of possession contained in Executive Order No. 91-254, which specifies the modalities for preparing and handing over the certificate of possession. The latter raises a number of disputes through the legal machinery that authorizes the owner, When it arises, or the rights of the other persons and the State, the jurisdiction of the chapter may be transferred to ordinary courts or administrative courts.
