الملخص
يتلخّص محتوى هذا المقال في عرض أهمّ الأخطاء المنهجيّة الشّائعة في الكتابة العلميّة للبحوث القانونيّة، الّتي تتفق مع غيرها من بحوث العلوم الإنسانيّة في العديد من الجوامع المشتركة، غير أنّها قد تتميّز عنها بخصوصيّة اللّغة القانونيّة المتفردة، الّتي تعتبر خاصية لصيقة بهذا التّخصّص دون غيره من التّخصّصات. إنّ البحث العلميّ يعتمد أساسا على سلسلة عمليّات مترابطة، وخطوات متتابعة، وأفكار منظّمة، تترجم أحد المناهج العلميّة المعترف بها، والمطلوب اتباعها في كلّ الدّراسات والبحوث العلميّة. وغالبا ما يقع الباحثون في العديد من الهفوات والأخطاء المنهجيّة، بدءً من صياغة العنوان وطرح إشكالية الموضوع، والخلط بين عناصر المقدّمة وحتى في تبويب محاور البحث الرّئيسيّة، وصولا إلى الخاتمة الّتي قد لا تتضمّن نتائج البحث ولا الاقتراحات. حيث تقدّم هذه الدّراسة تصويبات لأهمّ الانحرافات المنهجيّة في كتابة البحوث القانونيّة، وكذا سبل تجنّبها لإنجاز بحث قانونيّ سليم. The content of this article is summarized in presenting the most important common methodological errors in scientific writing of legal research, which agree with other human sciences research in many commonalities, but they may be distinguished from them by the unique specificity of legal language, which is considered a characteristic closely related to this specialization and not any other specializations. Scientific research depends mainly on a series of interconnected processes, sequential steps, and organized ideas that translate one of the recognized scientific methods that are required to be followed in all scientific studies and research. Researchers often make many lapses and methodological errors, starting with formulating the title and presenting the problem of the topic, mixing up the elements of the introduction, and even in categorizing the main research axes, all the way to the conclusion, which may not include the research results or suggestions. This study provides corrections to the most important methodological deviations in writing legal research, as well as ways to avoid them in order to achieve sound legal research.
