الملخص

تعد إشكالية العدالة من أكثر الإشكاليات الفلسفية التي حظيت باهتمام العديد من المفكرين والفلاسفة عبر التاريخ والزمن، سواء من حيث مبادئها أو أسسها وكذلك إمكانية تحقيقها على أرض الواقع على الصعيدين المحلي والعالمي، ويعتبر الفيلسوف الأمريكي جون رولز من أهم الفلاسفة الرائدين في هذا المجال حيث ترك بصمته القوية على هذا الموضوع فأعطى للمجتمعات الديمقراطية بصفة عامة والولايات المتحدة الأمريكية بصفة خاصة تصورا شاملا وواضحا للعدالة الإنسانية من خلال مشروعه السياسي الذي جسده في كتابيه نظرية العدالة وقانون الشعوب كبديل عن الأنظمة التي سادت طويلا وأهملت حرية الإنسان وجردت الروابط الإنسانية من أخلاقياتها حيث أكد أن نظريته سياسية وليست أخلاقية مما يجعل لها دورا خاصا، فهي لا تفصل بين الخير والشر أو معاملات الناس فيما بينهم ،بقدر ما سعى رولز إلى وضع جملة من المبادئ التي ينبغي أن تقوم عليها البنية الأساسية السياسية للمجتمعات من مؤسسات تشريعية واقتصادية وكل ما يخص البلاد، ويمكن صياغة إشكالية البحث كالتالي:هل يمكن تطبيق مبادئ نظرية العدالة الرولزية على المستوى العالمي من أجل تحقيق العدالة بين الشعوب المختلفة؟ كلمات مفتاحية: جون رولز، نظرية العدالة، قانون الشعوب، العدالة العالمية، الديمقراطية. Abstract: The problem of justice is one of the most philosophical problems that have attracted the attention of many thinkers and philosophers throughout history and time, both in terms of its principles and foundations, as well as the possibility of achieving it in practice at the local and global levels, the American philosopher John Rawls is considered one of the most important and pioneering philosophers in this field, as he left his strong mark on this subject, giving democratic societies in general and the United States of America in particular a comprehensive and clear vision of human justice through his political project, which he embodied in his two books, The Theory of Justice and the Law of Peoples, as an alternative to the regimes that have long prevailed and neglected human freedom and stripped human bonds of their morals, where he emphasized that his theory is political and not moral, which makes it a special role, as it does not separate between good and evil or the dealings of people among themselves as far as Rawls sought to develop a number of principles on which the political infrastructure of societies should be based on legislative and economic institutions and everything that pertains to the country Keywords: John Rawls; justice theory; the law of peoples global justice; democracy.
