ديمقراطية وشفافية الإنتخابات بين القوانين الدولية والنصوص الداخلية

الملخص
ملخص : تشكل الإنتخابات شرطا ضروريا لقيام أي حكم ديمقراطي كونها الأداة التي تُخوِّل للشعب التعبير بحرية عن إرادته ، حيث أنها تندرج في إطار التعبير عن السيادة وتضفي الشرعية على الحكم وتقيم دعائم السلطة ، لأنه عندما يكتسب الحكم شرعيته من خلال إجراء إنتخابات ديمقراطية نزيهة وشفافة، تخِف حدَّة التصارع غير الديمقراطي على السلطة، خاصة وأنه بدا واضحاً أن الحكومات التي لم يتم إختيارها من طرف شعوبها بصورة ديمقراطية وشفافة ، هي الحكومات المعرّضة لعدم الإستقرار والإضطرابات، وهي الأكثر عرضة للإنقلابات والتمرد والعنف، لذلك لابد أن تستند العملية الإنتخابية في أية دولة على معايير الحيادية والنزاهة والشفافية والديمقراطية ، وفقا لما هو مقرر في التشريعات الداخلية والمبادئ الدولية الخاصة بالإنتخابات. وعليه تهدف دراستنا إلى : تسليط الضوء على الأُطُر القانونية اللازمة لضمان شرعية ومصداقية العملية الإنتخابية والمعايير والأحكام الدولية والنصوص الداخلية المعتمدة لتحقيق ذلك، لإقامة الصّرح الديمقراطي، كون أن المساس بهذا الحق هو جناية وجريمة في حق الأفراد والجماعات. Abstract : Elections constitute a necessary condition for the establishment of any democratic government, as they are the tool that allows the people to freely express their will, as they fall within the framework of expressing sovereignty, conferring legitimacy on governance, and establishing the foundations of authority, because when the government gains its legitimacy through holding fair and transparent democratic elections, the intensity of the conflict is reduced. Non-democratic rule over power, especially since it has become clear that governments that were not chosen by their people in a democratic and transparent manner are the governments that are most vulnerable to instability and unrest, and are the most vulnerable to coups, rebellion and violence. Therefore, the electoral process in any country must be based on standards of neutrality, integrity and transparency. And democracy, in accordance with what is stipulated in internal legislation and international principles related to elections. Therefore, our study aims to: Highlighting The necessary legal controls to ensure the transparency and democracy of the electoral process, international standards and internal texts adopted to achieve . this, and establishing the democratic edifice, since violating this right is a felony and a crime against individuals and groups.
