الملخص
تتبدى حقيقة أن دور الأوقاف لا يتماشى في الجزائر قاصرٌ في حقيقة الأمر، ولم يف بعد بالمتوقع منهفي عملية التنمية، إذ إنه غير قادر على تلبية الاحتياجات العامة المتزايدة؛ لذايعد أمرًا ضرورياً العمل على تنمية الأوقاف، واستثمارها، وتحقيق أقصى استفادة من عائداتها. ونأخذ في اعتبارنا أن الأوقاف لها جوانب دينية وأخرى اجتماعية واقتصادية، وينبغي تنظيم الأنشطة الوقفية وفقًا لأحكام الشريعة الإسلامية؛ إذ إن الاستثمارات الوقفية تحتاج إلى إطار من الضوابط الشرعية، نظرًا لأنها تمثل عمليات مالية تستند إلى قوانين دينية وتتميز بخصوصية تعتبر حقوق المستحقين وشروط الواقفين في الاعتبار، ومن ثم يهدف البحث إلى مناقشة ضوابط استثمار الوقف بما يعود بالنفع على التنمية المستدامة من خلاله، كما توصل البحث إلى أن الوقف يعد مصدراً ثابتاً يمكن الاعتماد عليه لتحقيق الاستدامة من خلال تلبية الحاجات العامة والخاصة للدول والأفراد، كما يُظهر تأثيراً إيجابياً في مجالات متعددة The reality is that the role of endowments in Algeria is limited and has not yet fulfilled its expected role in the development process. It is unable to meet the increasing public needs. Therefore, it is necessary to work on developing and investing in endowments and maximizing their benefits. It should be noted that endowments have religious and social,economicalaspects, and endowment activities should be organized according to the provisions of Islamic law. Endowment investments require a framework of legal controls, as they involve financial operations based on religious laws and are characterized by their specificity, taking into account the rights of beneficiaries and the conditions of the endowers. Therefore, the research aims to discuss the controls for endowment investment that contribute to sustainable development. The research concludes that endowments are a reliable source that can be relied upon to achieve sustainability by meeting the general and specific needs of countries and individuals. They also have a positive impact in various fields.
