تعدد الزوجات على المستوى الدولي وإشكالية النظام العام

الملخص
تعتبر فكرة النظام العام من بين المسائل المهمة والمعقدة في القانون، وهو ما جعل الاتفاق حولها يكاد أن يكون معدوما، على الرغم من أنه لا خلاف حول مفعول النظام العام كوسيلة يتم بموجبها استبعاد تطبيق القانون الأجنبي. يعتبر الزواج عموما من بين المواضيع المثيرة للجدل كون أن هذه الأخير هو اللبنة الأساسية في تكوين المجتمع، وهو متصل اتصالا وثيقاً بالنظام العام وتعتبر أي خطوة منه منافية لما تم تحديده بموجب النصوص القانونية مسألة حساسة يجب الوقوف عندها، ومن بين المواضيع التي شهدت خلاف واضح بين التشريعات القانونية مسألة تعدد الزوجات التي كلما كانت تتسم بالطابع الدولي كلما ثار حولها وضعين مختلفين لتصرف واحد، وهو ما يستدعي البحث عن حل يقلل من حدة تعصب القاضي لقانونه الوطني وتمكين الافراد من القيام بمصالحهم ما دام ذلك في حدود المقبول عقلا ومنطقا The idea of public order is considered one of the important and complex issues in law, which has made agreement on it almost non-existent, although there is no dispute about the effect of public order as a means by which the application of foreign law is excluded. Marriage is generally considered one of the controversial topics because the latter is the basic building block in the formation of society, and is closely connected to the public order, and any step from it that contradicts what has been determined according to the legal texts is considered a sensitive issue that must be considered, and among the topics that witnessed a clear disagreement between Legal legislation is the issue of polygamy, which the more it has an international character, the more two different situations arise around it for one act. This calls for searching for a solution that reduces the intensity of the judge’s intolerance to his national law and enables individuals to carry out their interests as long as this is within the limits of what is rationally and logically acceptable.
