الملخص
أصبح إعطاء الحكم الشرعي للمعاملات المالية المعاصرة من أولويات الباحثين الشرعيين لاسيما مع التطور الكبير الذي نشاهده لهذه المعاملات من تنوع صورها وحاجت الناس إليها لانحدار وضعهم الاقتصادي، وتتضح المشكلة بعرض السؤال التالي: ما القواعد الفقهية الحاكمة للعقود من حيث الصحة والفساد والبطلان، وما التطبيقات الاقتصادية المعاصرة لهذه القواعد الفقهية الحاكمة للعقود؟ لذلك يهدف هذا البحث إلى دراسة الأحكام الفقهية الواردة على العقد وبيان القواعد الفقهية الحاكمة للعقود من حيث الصحة والفساد والبطلان، ومن ثم معرفة التطبيقات الاقتصادية المعاصرة للقواعد الفقهية الحاكمة للعقود من حيث الصحة والفساد والبطلان. واتبعت المنهج الوصفي في إعداد هذا البحث من خلال خاصيتي الاستنباط والاستقراء، حيث قمت بذكر القاعدة وذكر مصدرها ثم شرحها ، ثم ذكرت في المبحث الثاني التطبيقات المالية المعاصرة لها إن وجدت، وكانت أبرز النتائج أنه يوجد لكل قاعدة من هذه القواعد التي تم ذكرها تطبيق معاصر يحكم بها إلا بعض القواعد. Giving the legal ruling on contemporary financial transactions has become a priority for legal researchers, especially with the great development that we see for these transactions from the diversity of their forms and the people’s need for them due to the decline of their economic situation. For these jurisprudential rules governing contracts? Therefore, this research aims to study the jurisprudential rulings on the contract and to clarify the jurisprudential rules governing contracts in terms of validity, corruption and invalidity, and then knowing the contemporary economic applications of the jurisprudential rules governing contracts in terms of validity, corruption and invalidity. And I followed the descriptive approach in preparing this research through the characteristics of deduction and induction, where I mentioned the rule and mentioned its source and then explained it, then I mentioned in the second topic the contemporary financial applications for it, if any, and the most prominent results were that there is for each of these rules that were mentioned a contemporary application that governs It only has some rules.
