الملخص

الملخص: يثبت حق التوارث بين الزوجين بالزواج الصحيح ولو لم يتم الدخول، فإذا مات أحدهما ورثه الأخر، لكن قد يقع الطلاق بين الزوجين، ومع ذلك يبقى حق التوارث بينهما قائما إذا توفي أحدهما عن الآخر، لأن من الطلاق ما يقطع العلاقة الزوجية بمجرد وقوعه، ومنه ما يقطعها بعد مدة ، لتستمر الرابطة الزوجية وتبقى المطلقة خلالها في حكم الزوجة، وتظلّ معها آثار الزواج قائمة. فلقد ضبط الفقه الإسلامي موضوع التوارث بين الزوجين حال طلاقهما من خلال مجموعة من الأحكام الفقهية التي اعتمدت أساسا على العدة ونوع الطـلاق كمعيارين أساسيين لهذا التوارث، أما المشرع الجزائري فقد تناول هذا الموضوع بشكل مختلف عن ما جاء به الفقه الإسلامي، من خلال أحكام أثارت عديد الإشكالات القانونية. Abstract: The right of inheritance between the spouses is established by valid marriage, even if consummation is not consummated. If one of them dies, the other inherits it, but divorce may occur between the spouses. However, the right of inheritance between them remains valid if one of them dies from the other, because divorce is what breaks the marital relationship as soon as it occurs, and some of them include: He breaks it off after a period of time, so that the marital bond continues and the divorced woman remains in the same position as the wife, and the effects of the marriage remain with her. Islamic jurisprudence has controlled the issue of inheritance between spouses in the event of their divorce through a set of jurisprudential provisions that relied mainly on the waiting period and the type of divorce as two basic criteria for this inheritance. As for the Algerian legislator, it dealt with this issue in a different way than what Islamic jurisprudence stated, through provisions that raised many Legal problems.
