التدخل الدولي البيئي بين اللامشروعية وحماية الإنسانية

الملخص
يعتبر دخول الإنسانية الساحة الدولية، وتنامي الاهتمام بها لدرجة اعتبارها من قبل البعض كشخص من أشخاص القانون الدولي، نقطة تحول كبيرة جعلت من الاهتمامات المشتركة للجنس البشري تلقى هي الأخرى ردة فعل دولية، ولعل البيئة من أبرز تلك الاهتمامات نظرا لارتباط الإنسانية بها، بل واعتبارها من أحد عناصرها هذا من جهة، ومن جهة أخرى فإن طبيعة الأضرار البيئية إنتشارية حيث تمتد لمسافات بعيدة، ومتراخية تتدرج عبر الزمن لتلحق الأذى بالأجيال الحالية والمقبلة . إن هذه المعطيات جعلت الضرر البيئي الذي يصيب دولة ما يهدد البشرية جمعاء في حاضرها ومستقبلها، لذا أصبح التدخل الدولي البيئي لحماية الإنسانية من بين الظواهر المحتمل حدوثها خاصة وأن البيئة كحق من حقوق الإنسانية -حسب ما جاء في إعلان باريس حول حقوق الإنسانية لسنة 2015- أصبحت ترتبط بالأمن الدولي للإنسانية، وهذا ما يثير الجدل حول مشروعية التدخل الدولي البيئي لاعتبارات حماية الإنسانية. Abstract: The entry of humanity into the international arena, and the growing interest until being considered as a person of international law, is a major turning point that made the common concerns humans receive an international reaction. Indeed, the environment is one of the most prominent of these concerns due to humanity’s association with it, it is even considered one of its elements. Moreover, the nature of environmental damage is widespread, and is lax and gradual over time to harm current and future generations. These facts made the environmental damage that afflicts a country threatens all humanity in its present and future. Hence, international environmental intervention to protect humanity has become among the possible phenomena, especially since the environment as a human right - according to the Paris Declaration on Human Rights for the year 2015 - has become linked to the international security of humanity. Accordingly, this raises a debate about the legality of international environmental intervention for protecting humanity.
