الملخص
الملخص: يترتّب على التزايد المستّمر في البطاقات المتداولة وتعدّد أشكالها زيادة المنازعات المدنية والجنائية؛ المترتّبة على الإخلال بالالتزامات النّاشئة عن العلاقات التّي تربط بين أطراف البطاقة، ممّا تنعقد معه المسؤولية المدنية عن الأضرار التّي تصيب الأطراف الأخرى. والمسؤولية المدنية في إطار العلاقة الائتمانية تنشأ نتيجة إخلال أحد أطراف العلاقة بالتزام من التزاماته. وبذلك تنعقد المسؤولية المدنية النّاتجة عن استعمال البطاقة على أساس تعاقدي؛ حيث يفتّرض الخطأ من جانب الطّرف الذي لم يقم بتنفيذ التزاماته. وقد تنشأ المسؤولية التّقصيرية في حالة فقد البطاقة أو سرقتها من طرف شخص آخر وقيامه باستخدامها. وأي كان نوع المسؤولية المدنية فمحلها هو جبر الضّرر النّاتج عن الخطأ المرتّكب؛ سواء من قبل حاملها أو من قبل المصدّر لها، أو التاجر المعتّمد أو حتى الغير بدفع تعويض عادل. Abstract: The continuous increase in the number of cards in circulation leads to an increase in civil and criminal disputes caused by breaching the obligations arising from the relations between the card parties, which leads to civil responsibility for damages to other parties. Civil liability (responsibility) within the framework of the fiduciary relationship arises as a result of a breach by one of the parties to the relationship of one of his obligations. Thus, the civil liability resulting from the use of the card is contracted on a contractual basis; It assumes fault on the part of the party who has not fulfilled its obligations. Tort may arise if the card is lost or stolen by another person who will use it. Whatever the type of civil liability, its goal is the reparation of the damage resulting from the error committed, whether by the holder, by the exporter, the authorized dealer or even third parties to pay fair compensation.
