الملخص

يعتبر موضوع حقوق الطفل من المواضيع التي حازت على اهتمام المنظمات الدولية والإقليمية والتشريعات الوطنية، وهي حقوق تتميز بالتجدد والتطور على حسب الظروف الراهنة فالطفل هو اللبنة الأساسية الذي يبنى عليه أي مجتمع إذا ما نشأ في بيئة محاط بالرعاية والحماية الكافية التي يتطلبها نموه عبر جميع مراحله، من خلال هذا الموضوع نتعرض لحماية حقوق الطفل في الجزائر وفقا لما نص عليه القانون رقم 15-12 المتعلق بحماية الطفل الذي خص فئتين من الطفولة بحماية خاصة وهي الطفل في خطر، والطفل الجانح، كما أنه تدارك فئة أخرى من الأطفال معرضة للخطر ضمن القانون الجديد رقم 23-04 المتعلق بالوقاية من الاتجار بالبشر، وتهدف هذه الدراسة إلى إبراز الآليات والضمانات التي استحدثها المشرع الجزائري من خلال هذا القانون ومدى كفايتها في توفير الحماية اللازمة للطفل. Abstract : Children's rights are among the topics that have gained the attention of international and regional organizations, and national legislation. Children are the building blocks of a society if it arises in an environment surrounded by the care and adequate protection required by its development at all stages, Through this topic, we are exposed to the protection of children's rights in Algeria, as stipulated in Law No. 15-12 on the Protection of Children, which provides for special protection for two categories of children. children in conflict with the law, as well as addressing another group of children at risk under the new Law No. 23-04 on the Prevention of Trafficking in Human Beings The aim of this study is to highlight the mechanisms and safeguards introduced by Algerian legislation through this Act and their adequacy in providing children with the necessary protection.
