تقييم الأثر البيئي لمشاريع استغلال الشواطئ: آلية تحقيق الجزائر لمسعى التنمية الاقتصادية المستدامة

الملخص
عمل المشرع الجزائري على وضع نظام قانوني يكرس الحماية القانونية للشواطئ كأهم ثروة طبيعية تزخر بها الجزائر على امتداد 1622 كلم من شريطها الساحلي، حيث لم يتوان عن إيلاء الأهمية للبعد البيئي في ذلك، فجعل من دراسة مدى التأثير على البيئة إحدى أهم الآليات الإدارية ذات الطابع الوقائي التقني التي تضمن تحقيق مسعى التنمية المستدامة المرجوة من استعمال واستغلال الشواطئ، وفق ما رسم من مخططات التنمية الاقتصادية في الدولة. ومن خلال هذه الدراسة ارتأيت الوقوف على الإطار القانوني المنظم لدراسة مدى التأثير على البيئة، بغية تحديد الطبيعة القانونية لهذه الآلية، والوقوف على دورها في تحقيق الجزائر لمسعى التنمية الاقتصادية المستدامة في مجال استغلال الشواطئ. The Algerian legislator worked to establish a legal system that enshrines legal protection for the beaches as the most important natural wealth that Algeria abounds in along 1622 km of its coastal strip, as he did not hesitate to give importance to the environmental dimension in that, so he made the study of the impact on the environment one of the most important administrative mechanisms of a preventive nature technical means that ensure the achievement of the desired sustainable development endeavor from the use and exploitation of the beaches, according to what was drawn from the economic development plans in the country. Through this study, we decided to stand on the legal framework organizing the study of the extent of the impact on the environment, in order to determine the legal nature of this mechanism, and to stand on its role in Algeria's achievement of the endeavor of sustainable economic development in the field of exploitation of the beaches.
