الملخص

الملخص: يلعب الاستثمار الأجنبي دورا بارزا في تدفق رؤوس الأموال وتوظيفها في مشاريع استثمارية في مختلف ‏القطاعات لتحقيق أهداف الدولة الاقتصادية والاجتماعية، ويلعب المستثمر الأجنبي دورا بارزا في تحريك عجلة التنمية ‏الاقتصادية في الدول المضيفة، إلا أنه ونظرا لتعارض مصالح المستثمر الأجنبي مع مصالح الدولة المضيفة للاستثمار قد ‏تنشأ نزاعات بينهما تتطلب التسوية بتوفير وسائل قانونية كفيلة بالتصدي لها تنسجم وطبيعتها وقادرة على تحقيق التوازن ‏بين أطرافها، كأن يلجأ المستثمر الأجنبي في حال فشل سبل التسوية الرضائية في حل النزاع بينه وبين الدولة المضيفة ‏للاستثمار لطلب حقه في الحماية الدبلوماسية عند تعرض مصالحه الاستثمارية للضرر في الخارج فتمد دولة الجنسية ‏حمايتها الدبلوماسية له، بما يضمن ويكفل له التمتع بكافة الحقوق والمزايا المعترف بها في إطار القانون الدولي وهذا ما ‏قررنا استعراضه من خلال ورقتنا البحثية هاته.‏ Abstract: Foreign investment plays a prominent role in the flow of capital and its employment ‎in investment projects in various sectors to achieve the state’s economic and social goals. ‎Disputes between them require settlement by providing legal means to address them that are ‎consistent with their nature and able to achieve a balance between their parties, as if the foreign ‎investor resorts in the event of failure of consensual settlement methods to resolve the dispute ‎between him and the host country for investment to request his right to diplomatic protection ‎when his investment interests are harmed abroad, so it extends The country of nationality has ‎diplomatic protection for him In a manner that guarantees and guarantees him the enjoyment of ‎all the rights and benefits recognized under international law, and this is what we decided to ‎review through our research paper‏.‏
