الملخص
كفل المشرع الجزائري حماية للطرف المذعن باعتباره الطرف الضعيف في عقد الإذعان، وهذا من الطرف القوي الذي يتمتع بسلطة احتكارية من خلال فرض إرادته على الراغبين في التعاقد دون التمكن من مناقشة هذه الشروط ، وعليه نحاول من خلال هذا البحث الإجابة حول سلطة القاضي التي منحه إياها المشرع لتحيق هذه الحماية.من خلال تقسيم البحث إلى مبحثين. Résumé: Le législateur algérien a garanti la protection de la partie soumise, étant faible dans le contrat de conformité par rapport à la dominante qui jouit d'un certain pouvoir de monopole en imposant sa volonté aux entrepreneurs sans négocier les conditions. Par conséquent, les deux .parties de cette recherche tentent d'enquêter sur l'autorité du juge dans l'octroi de cette protection. Abstract: The Algerian legislature has guaranteed protection for the submissive party, being weak in the compliance contract compared to the dominant that enjoys certain monopoly power by imposing their will on contractors without negotiating conditions. Therefore, the two parts of this research tries to investigate the judge’s authority in granting this protection.
