مثارات الغلط في تخريج الفروع على الفروع للنوازل المالية المعاصرة Triggers Of Error In Graduating Branches Over Branches Of Contemporary Financial Issues

الملخص
ملخص: يعمد بعض الباحثين لإيجاد الحكم المناسب للمستجدات المالية المعاصرة، إلى البحث عن نظائر لها تخرّج عليها، ومن ثم الركون إلى ذلك القول المخرَّج وتصحيح المسألة محل البحث دون النظر في وجاهة ذلك التخريج أو قوة ذلك القول من حيث الأدلة. وتهدف هذه الدراسة إلى بيان الأخطاء المنهجية التي تثار أثناء إجراء منهج تخريج الفروع على الفروع في الصناعة المالية الإسلامية، والتمثيل لهذه الأخطاء ومحاولة البحث عن سبل معالجتها. وقد أمكن من خلال البحث تحرير بعض هذه الأخطاء، من مثل: تكلف بعض الباحثين في الاعتماد على مسلك تخريج الفروع على الفروع في الصناعة المالية الإسلامية، التخريج على الأقوال الشاذة والضعيفة متخذا الخلاف وتعدد الأقوال حجة كافية في الاختيار دون النظر في وجاهة هذا التخريج، عدم مراعاة تبدل الأعراف، إهمال النظر في الفروق المؤثرة عند التخريج، التخريج بمجرد الشبه بين المسائل، والوقوع في التلفيق الممنوع. Abstract: Some researchers, in order to find the appropriate religious ruling for contemporary financial issues, search for analogues for it, and then rely on that derivation and correct the issue in question without considering the relevance of that graduating or the strength of that statement in terms of evidence. This study aims to explain the methodological errors that arise during the course of conducting the branch-by-branch graduation curriculum in the Islamic financial industry, and to represent these errors and try to search for ways to address them. Through the research, it was possible to edit some of these errors, such as: the cost of some researchers in relying on the course of graduating branches over branches in the Islamic financial industry, graduating on the anomalous and weak sayings, taking the dispute and the multiplicity of sayings as a sufficient argument in choosing without considering the relevance of this grading, not Taking into account the change in norms, neglecting to consider the differences affecting the graduation, the graduation by mere similarities between the issues, and falling into the forbidden fabrication.
