الملخص
كتب فقه الوثائق والعقود مما جاد به الفقه المالكي وصار علامة مميزة له، فقد أجاد فقهاء المالكية في هذا الباب الفقهي التفصيلي الذي يعنى بمعاملات الناس وضبطها بعقود فقهية محكمة نابعة مما يسجل من اختلالات في المعاملات الحياتية اليومية بين أفراد المجتمع، سواء في شقها الإيجابي أو الاحترازي، وإنما الاحتراز يكون عن الاختلالات المتوقعة أو التي وقعت فعلا والتي تهدد المجتمع، وإن التنصيص على هذه السلوكات الاجتماعية والتحرز منها بكتابة فقهية ضابطة لتؤمن حقوق الغير لمن الوسائل المهمة التي حملها المشروع المالكي في اصلاح المجتمع، وإن قراءة ذهنية الموثق الفقيه حين تدوينه لعقوده أو الموثق المؤلف حين تجميعه لوثائقه لكفيلة بإعادة رسم بعض الملامح عن الآفات المجتمعية التي عرفها مجال الغرب الإسلامي، وإن هذا الاتساع في المجال ورغم وحدة المذهب فإنه قد يحيل إلى خصوصيات بعض الحواضر حتى في مشاكلها الاجتماعية لاختلاف خصوصيتها وأقاليمها ومواردها، وعليه فقد ظهرت مؤلفات خاصة بحواضر دون غيرها كوثائق البجائي، وثائق المازوني، وثائق الغرناطي، وثائق ابن راشد القفصي، الوثائق المجموعة، إضافة لأعمال ابن مغيث، ابن سلمون، ... كتب فقه الوثائق العديدة التي تزيد عن الأربعين مؤلفا والتي كان موضوعها الأساس كلها هو المجتمع وهدفها معالجة مشاكله وآفاته، فإن عرض بعض نماذجها كفيل بإعطاء صورة أخرى عن مشروع المالكية في إصلاح المجتمع وضبطه من خلال الكتابة الفقهية المحكمة والعقود المبرمة الضامنة للحقوق في كل مناحي التعاقد: الأسري، المالي، الحرفي، العمراني، ... إن انفتاح هذا النوع المصدري على كل فئات المجتمع قد تعرفنا عن اعتلالات المجتمع من الشجارات والتدمية، والتعدي على الملكيات، إضافة للمناكر كضرب المزامير والسكر وإكراء المحلات لليهود، كما يفيد كثيرا في النزول إلى طبقاته السفلى ومعاينة آفاتهم كإباق العبيد، وتزويج صغار البنات دون سن البلوغ، والصعود إلى علية القوم كوثائق التسري، وتطليق الزوجة الثانية، بل أنها تفيدنا حتى في التعرف على مشاكل البحر وهو ما خصص له أبو فراس القيرواني كتاب خاص وعليه فإن تقديم وتحليل بعض كتب فقه الوثائق ودراسة بعض العقود مما يفيد في إبراز جهود علماء الغرب الإسلامي في معالجة الآفات الاجتماعية. Invention summary, Documents and contracts jurisprudence have been written from what the jurisprudence Maliki offered and it became a distinctive sign for it .The Maliki jurists excelled in this detailed jurisprudential section that deals with people's transaction and controlling them with court jurisprudential contracts stemming from what records imbalances in daily life transactions between members of society whether in its positive or precautionary aspects. Rather precaution is about expected or actually occurring imbalances that threaten society , and stipulating these social behaviours and avoiding them in jurisprudential writing to secure that rights of others is one of the important means carried by The Maliki project in reforming society , and reading mentality of the notary jurist when he wrote down his contracts or the notary author when he collected his documents in sufficient redraw some features of the social . Societal scourages that the field of the Islamic Western knew, and that this breadth in the field and despite the unity of the doctrine may refer to the privacy of some urban areas even in their social problems due to the difference in their privacy and regions . And it's resources accordingly , there have been a publications to urban to urban cities not others , such as the documents of El -Mazoni the documents of the documents of Ibn Rashid Al - Qafsi ,the collected documents , in addition to the works of Ibn moughith , Ibn Salmon ,... He wrote the jurisprudence of the numerous documents that exceed fourty author s whose main theme was all of society and its aim is to treat it's problem and it's afflictions . The presentation of some of its models in a sufficient to give another picture to The Maliki in reforming and controlling society through the book. Reforming and controlling society through jurisprudential writing and concluded contracts that guarantee rights in all aspects of contracting , financial, vocational, urban ,.. the openness of this source type to all segments of society has taught us about the ills of society such as quarrels , bloodshed , and encroachment on property , in addition to evils such as beating flutes, drunkenness ,and renting shops to the Jews , it also helps a lot in going down to its lower layers and examine their afflictions such as , keeping slaves , marrying of all young girls under the age of puberty , and extending to the attic of the people such as concubinage documents and divorcing the second wife . What Abu Firas Al -Qayrawan devoted a special book to, and accordingly , presenting and analysing some books on jurisprudence of documents and studying contracts, which is useful in highlighting the efforts of western Islamic scholars in dealing with social pests.
