الملخص
تعد المخطوطات من أهم مصادر البحث التاريخي في وقتنا الحالي، فهي ملاذ الباحثين للكشف عن قضايا تاريخية مهمة تعرفهم أكثر عن طبيعة المجتمعات. تزخر الجزائر بكم هائل من المخطوطات التي تحتويها الخزائن العامة والخاصة، الأمر الذي يجعل منها تراثا ماديا يثري الهوية الوطنية ويعزز من ثقافتنا العربية والإسلامية، لاسيما في الفترة الوسيطة، وقد انهال الباحثون والمؤرخون عليها وعملوا على تحقيق جزء كبير منها، إلا أنه لا تزال هناك مخطوطات ذات أهمية لم تطلها أيادي المحققين أو أنهم في طريقهم إلى ذلك، وفي هذا الصدد يسعني التعريج على إحدى المخطوطات الثمينة والقيمة والتي تخدم الباحثين خصوصا في حقول التاريخ، على الرغم من أنه يعالج مسألة فقهية، وأقصد بالذكر: "مخطوط تحفة الوارد في اختصاص الشرف من قبل الوالد "لمؤلفة المعروف ابن قنفذ القسنطيني، من خلال مقالة وُسمت بـ: " قراءة في مخطوط تحفة الوارد في اختصاص الشرف من قبل الوالد". تأتي هذه الدراسة لتغطية ولو جزء بسيط من الإنتاج المعرفي لعلماء المغرب الأوسط عامة وعلماء قسنطينة خاصة، كون ابن القنفذ من أشهر أعلامها الذين نبغوا وتفننوا في فن الكتابة والتأليف كما هو موضح في المتن لاحقا. إن مخطوط تحفة الوارد جاء ليميط اللثام عن مسألة شائكة نتج عنها اختلاف وتضارب في الآراء بين الفقهاء حول مسألة النسب الشريف، ومن هنا جاء دور الفقيه والعلامة ابن قنفذ ليحسم الأمر في هذا الاختلاف ويقيم الحجة والدلائل على ضرورة نسب الابن لأبيه في كل الحالات، وهذا ما سأتطرق بالتفصيل فيه من خلال هذه الورقة البحثية والتي اعتمدت فيها: مقدمة تمهيدية توضح الأحداث المحيطة بعصر المؤلف والتي تنم عن حركية الفكر والإنتاج المعرفي آنذاك وما يدور حوله من اختلافات وتباين في وجهات النظر، تعريجا إلى التعريف بالمؤلف ثم مخطوطه، وتفصيل ما جاء في أبوابه الثلاثة استنادا إلى تقسيم صاحبه، وصولا إلى خاتمة توضح الاستنتاجات التي خلص إليها البحث. Abstract: Manuscripts are among the most important sources of historical research in our time,as they are a haven for researchers to uncover important historical issues that teach them more about the nature of societies. Algeria abounds with a huge amount of manuscripts that are contained in public and private treasuries, which makes it a material and rich heritage of national identity and enhances our Arab¬¬ Islamic culture for a woman in the middle period. The investigators did not ask for it, or they are in the way to that. In this regard, lcan pass by one of the precious and valuable manuscripts tha served researchers, especially in the fields of history, It was labeled. “A reading in the masterpiece manuscript contained in Proof of Honor by the Father” Ibn Qunfuth Al casantini. This study comes to cover even a small part of the knowledge production of the scholars of the midle Maghreb in general and the scholars of Constantine in particular, the fact that Ibn Qunfuth is one of the most famous of its declaration, who excelled in the art of writing and composition, as shown in the later. Issue that resulted in a difference and conflict of opinions between the jurists on the issue of honorable, hlce the role of the jurists Ibn Qunfuth to resolve the matter in this differenceand establish the argument and evidence for the necessity of attributing the son to his father in all cases, and this is wahat l will discuss ti him in detail in it through this research paper in which it was adopted : an introductory introduction that explains the events surrounding the era of the author, which reflect the movement of thought and knowledge production at that time, a meander to the definition of the author and then his manuscript, and a beakdown of watch came in its author, leading to a conclusion that explains the conclusion reached by the research.
