الأحكام الشرعية للمعاملات المالية في تكنولوجيا الميتافيرس

الملخص
تناولت هذه الدراسة قضية المعاملات المالية في البيئة الافتراضة "الميتافيرس" ومدى تحقق الضوابط الشرعية للعقود باستخدام تقنية البلوكتشين بعيدا عن وساطة الاقتصاد المركزي، وكان الإشكال يتعلق بمدى الأمان في التصرفات المالية بالنسبة للمتعاقدين في عالم الميتافيرس خاصة في ضوء الفراغ القانوني والفقهي المساعد على التحكم في ما يجري في هذه البيئة، كما تم بحث قضايا المخاطرة والغرر وأحكام التصرفات العقدية من بيع وإجارة وتملك وتمويل مما يتداوله الناس والشركات بواسطة تقنية البلوك تشين في هذا العالم الافتراضي، ووصلنا إلى أن التعامل في الميتافيرس يتم على أصول مشفرة غير مادية تحتاج على تشريعات عقدية خاصة، تدرأ الغرر والمخاطرة، وإن القول بإباحة التعامل بتقنية البلوك شين لما تتميز به من صفات الأمان ولما يترتب عليها من توافر شروط مجلس العقد الصحيح في طريقة بنائها وأدائها، يترتب عليه القول بإباحة التعامل المالي في الميتافيرس بيعا وشراء واستثمارا بضوابه الشرعية الكلمات المفتاحية: ميتافيرس – معاملات مالية- ويب3- فقه إسلامي. Abstract: In the hypothetical "Metaverse" environment and the extent to which legal controls of contracts are achieved using blockchain technology away from the mediation of the central economy. It takes place in this environment, and issues of risk, deception, and contractual arrangements such as sale, lease, possession, and financing have been discussed by people and businesses using blockchain technology in this virtual world.
