الملخص
ملخص: يتضح لنا أن المشرع الجزائري أخضع تعيين الحارس القضائي لطريقتين تتمثل الأولى في أنها اتفاقية، إذا اتفق ذوي الشأن جميعا على الحارس القضائي. أما الثانية فهي قضائية، لما يعين الحارس بحكم القاضي عند وقوع الخلاف في تعيينه . وتتعدد حالات تعيينه حسب طبيعة النزاع المثار من أصحاب المال المنقول أو العقار سواء كان ملكية خاصة أو مشتركة شائعة. Abstract: It is clear to us that the Algerian legislator subjected the appointment of the syndic (trustee) to two methods, The first is an agreement, as all concerned parties agree on the syndic, whil the second is judicial when the receiver is appointed by the judge’s ruling when a dispute occurs in his appointment. Ther are many cases of his appointment according to the nature of the dispute raised by the estate, whether it is private or apparent ownership
