الملخص

تناولت الدراسة موضوع مكافحة جريمة التحريض على خطاب الكراهية عبر وسائل التواصل الاجتماعي التي تعد أكثر الجرائم انتشارا مؤخرا وأخطرها خاصة وأنها تهدد أمن الدول واستقرارها حيث ساهمت البيئة الرقمية في سهولة انتشارها وتداولها بما تحمله في طياتها من تحريض وتحفيز على الكراهية وما يترتب عليها من آثار وخيمة كالعنف والتمييز وغيرها من أضرار على المجتمع قد تؤدي إلى الانقلابات والحروب الداخلية وحتى الإبادات الجماعية، والجزائر كغيرها من الدول جرمت التمييز وخطاب الكراهية وكان القانون 20/05 دليل سعيها في مجابهة هذه الجريمة ومكافحتها لاسيما في ظل الفضاء الرقمي الذي يشكل مسرحا مناسبا لاستفحالها وتداولها بشكل يدعو إلى دق ناقوس الخطر وطنيا ودوليا.
