الملخص
من خلال هذه الدراسة، تبيّن لنا أنّ الاعتماد على معايير جودة الصياغة القانونية، التي تتمثل بالخصوص في كفاءة وخبرة الصائغ والتزامه بأخلاقيات المهنة، وإتقان اللغة، ومراعاة الصلة بين التشريع المصاغ والقوانين السارية في الدولة؛ تمنح القاعدة القانونية الشكل العملي الذي يجعلها صالحة للتطبيق؛ فالصياغة التشريعية لقواعد قانونية مجردة، وغير مبهمة؛ تجعل القانون سهل الفهم والتطبيق في أرض الواقع، وتجنب القضاء عناء التفسير والتأويل، وتُحقّق الأمن القانوني دون المساس بسلطة القضاء. وتبيّن لنا أيضا أنّ أهم عيوب الصياغة القانونية تتمثل في الخطأ، النقص، التعارض، الغموض. وأنّ من أهم المشاكل التي يواجهها صائغ التشريع، صعوبة فهم وتفسير النص المقترح من طرف المشرع؛ لذا على الصائغ أن يأخذ بعين الاعتبار هذه المشاكل أثناء عملية الصياغة؛ أضف إلى ذلك عدم وجود منهجية في الصياغة قد تؤدي أحيانا إلى أخطاء في إرادة الصائغ؛ مما يؤثر على استقرار التشريع. Through this study, it became clear to us that relying on the quality standards of legal drafting, which translate in particular into the skill and experience of the jeweler and his attachment to the ethics of the profession, the mastery of the language, and taking into account the link between the legislation drafted and the laws in force in the country; The rule of law gives the practical form which makes it applicable; The legislative formulation of abstract legal rules is not vague. It makes the law easy to understand and apply on the ground, and the judiciary avoids problems of interpretation and interpretation, and it provides legal certainty without prejudice to the authority of the judiciary. We also found that the most significant flaws in legal drafting are error, gap, contradiction, and ambiguity. One of the biggest problems faced by drafters of laws is the difficulty of understanding and interpreting the text proposed by the legislator. Therefore, the jeweler must consider these issues during the drafting process. Add to this the lack of methodology in the drafting which can sometimes lead to errors in the jeweler's will. This affects the stability of the legislation.
